1. Agreement

These Terms of Use govern your use of surfsup.site and purchases from SURFSUP / AnotherWav (“SURFSUP,” “we,” “us”). By using the site or placing an order, you agree to these terms.

2. Products and pricing

We may sell digital producer tools, sample packs, loops, physical goods, memberships and related creative products. Prices, availability, descriptions and product contents may change. We will charge the price displayed at checkout, subject to applicable taxes and any clearly disclosed promotion.

3. Digital products and licenses

Digital products are licensed for the uses described with the product. Unless a product’s license says otherwise, you may use the sounds in your own musical productions, including commercial releases, but you may not resell, redistribute, repackage, upload or make the source files available as a competing sample library or standalone download. You are responsible for reviewing the specific license included with each pack.

4. Physical goods

Physical goods may be made to order and fulfilled by a third-party fulfillment provider. Standard U.S. shipping is included in the listed retail price unless a product page states otherwise. International orders may be subject to customs duties, taxes or other charges imposed by the destination country.

5. Payments

Payments are processed through PayPal. We do not receive or store your full payment-card number. PayPal may apply its own terms, policies and fraud or verification controls.

6. Intellectual property

Site text, graphics, logos, artwork, branding, software and other SURFSUP materials are owned by or licensed to us and may not be copied or commercially exploited without permission.

7. User submissions

If you submit sounds, files, messages or other material through the site, you represent that you own or control the rights needed to submit them and that your submission does not knowingly infringe another party’s rights. A submission does not guarantee a response, collaboration, placement or payment.

8. Disclaimers

The site and its content are provided on an “as available” basis. We do not guarantee uninterrupted availability, compatibility with every device or browser, or that every feature will remain unchanged.

9. Limitation of liability

To the extent permitted by law, SURFSUP will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of the site or products. Nothing in these terms limits rights that cannot legally be limited.

10. Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.
